Sex work is set to be decriminalised and regulated in Queensland with a major shake-up promising to bring the industry ‘out of the dark’ and make it safer for those in the profession.

Attorney-general Shannon Fentiman confirmed the government would use findings from a Queensland Law Reform Commission report as a springboard to overhaul current laws.

Until the new law is passed only two forms of sex work are legal in the Sunshine State – services provided at a licensed brothel, and when a person is working alone from a premises, providing in-house or outcall services, or both.

All other forms are illegal – including escort agencies, unlicensed brothels, massage parlours, street workers who solicit in public and those who work in small groups.

The illegal forms of sex work currently make up the majority of services.

‘Current laws stigmatise sex workers, it increases their vulnerability to exploitation and violence,’ Ms Fentiman told 7 News.

‘We need to bring sex work out to off the dark and properly regulate the industry particularly for the safety of workers.’

The Queensland Government committed to decriminalising the sex work industry in April 2022 with the commission’s completed review findings setting the stage for a regulatory framework.

That framework will have a major focus on the safety of sex workers.

Advocates in favour of decriminalisation claim that existing regulations made sex work less safe, by prohibiting women operating in pairs or employing someone to screen and book clients and provide security on jobs.

The Queensland government is expected to consult with local government before finalising the new laws.

The commission is understood to have made 47 recommendations most of which have not yet been released publicly.

One proposed laws will allow individual sex workers to operate out of their homes, as long as they had obtained received council planning approval.

The change would allow sex workers to essentially operate like any other home business.
