Moment man is put in CHOKEHOLD after getting into fight on NYC subway

A fight on a subway car in Manhattan turned into an all-out brawl involving another passenger after one of the men fell on his partner – and ended up in a chokehold.

Shaky video taken discreetly by a passenger first focuses on two men squaring up by one end of the subway car. The men travel down the length of the car, trading punches – when one is knocked on top of a seated woman.

Her partner takes matters into his own hands, putting the man in a headlock – and only lets go when another passenger shouts that the man can’t breathe.

The scene is eerily similar to footage that circulated in May showing the moment Jordan Neely, a homeless man, was put in a fatal chokehold by Daniel Penny on the F train.

The former U.S. Marine was charged in relation to Neely’s death – but just last week, his lawyers argued that the case should be dismissed, as witnesses were worried they were ‘going to die.’

In the video recently posted to Reddit, two men stood with their fists raised on the Manhattan subway car.

‘Touch me,’ said one man off camera.

‘I’m trying, boy,’ said the other, who was clad in all black.

The pair faced off before the first man, wearing jeans and a facemask, lunged at the man in all black. He chased him down the train car as they exchanged blows.

The man in black shoved the other into a couple seated by the door. The woman quickly got up and hurried to the opposite end of the car.

Her partner, however – a muscular man with a sleeve tattoo on one arm – threw off his jacket, revealing a t-shirt with a tiger on it.

The man in black cornered the other and pummeled him as he cowered against the subway seats.

When he rose, the man in the tiger t-shirt grabbed him and put him in a headlock.

He raised both hands in surrender, gesturing to the arm around his neck while looking pleadingly at a woman in green pants seated across from him.

‘Settle down! Relax! You don’t put your hands on a woman! You hear me?’ the tattooed man shouted.

He continued to shout ‘Relax, settle down,’ when the woman in green pants piped up.

‘He is choking! Stop!’ she yelled, prompting the man to let go.

‘You ain’t wrong!’ he shouted, pointing at the man in black, who stood nearby.

The other man sat on the floor with a bewildered expression, panting.

‘I can’t breathe,’ he said. ‘I can’t breathe.’

The man in all black took the opportunity to land another punch, prompting the other to scramble to his feet and escape down the car.

‘Motherf******!’ the man in the tiger t-shirt said.

The train drew to a halt at the Canal Street Station, where the man in black pointed menacingly at his attacker before getting off.

‘Anybody else who got a f***ing problem?’ the tattooed man shouted, wheeling around. ‘Anybody?’

He acknowledged his partner for the first time, telling her, ‘Sit down baby,’ before she came back into view.

The altercation bore a striking resemblance to the events that caused the death of 30-year-old Jordan Neely.

On May 1, the homeless man was killed by 24-year-old Daniel Penny on a Manhattan subway car.

After Neely boarded, he reportedly began screaming that he was hungry, needed a job, was not afraid of going to prison, and was ready to die.

After Neely removed his jacket and threw it to the floor, Penny approached from behind and put him in a chokehold. 

Penny kept the hold even after the train reached the next stop and applied it for nearly a minute after Neely had gone limp.

Neely’s death was ruled a homicide by compression of the neck on May 4.

On May 11, Penny was charged with second-degree manslaughter. A month later, he was formally indicted by a grand jury. When the indictment was unsealed on June 28, it revealed an additional charge of criminally negligent homicide.

Penny pleaded not guilty to both charges.

Just last week, Penny’s defense attorneys requested that the judge to dismiss the case due to testimony from grand jury witnesses who were on the train.

One of those riders was afraid he ‘was going to die’ when Neely approached. A high school student also claimed that Neely said ‘someone is going to die today,’ according to court documents.

In a statement, Penny’s lawyers argued that the evidence presented to the grand jury was ‘legally deficient’ and that Neely ‘was a threat and people feared for their lives.’ 

If convicted, Penny faces up to 19 years in prison.
