On Thursday, an Alabama judge postponed a court hearing for the mother of a missing 1-year-old boy who is now presumed dead.

Kahleb Collins’ grandfather, John Bailey, 50, is charged with failing to report his disappearance, and his mother Wendy Bailey, 22, is charged with child abuse for failing to intervene or report child abuse carried out by the toddler’s father. Fayette County District Attorney Andrew Hamlin asked the court to postpone the pair’s preliminary hearing, scheduled for January 15, as they continue their investigation, according to TK.

Collins was reported missing on December 9, a day after his father crashed into a tree — killing him and Collins’ 2-year-old sister. Wendy Bailey was seriously injured in the crash.

Wendy Bailey was charged with negligent homicide as her daughter was allegedly unrestrained in the car when the crash occurred. The children’s father was reportedly driving at 90 mph when he swerved off the road, hit a tree, and was ejected from the vehicle.

Collins is now presumed dead, as it was determined he was not in the December 8 car crash. Wendy Bailey is also charged with abusing a corpse as investigators believe Collins — who was last seen in early September — has been dead for several months.

Investigators wrote that, on at least two instances, Wendy Bailey witnessed Collins “being bound with rope, physically assaulted, and being bound by a rope from a loft with blood and bruising present.” Authorities said Collins’ body was put in a bag and stashed in a storage building. His body was eventually discarded at an unknown location, they also said.

WBMA reported that Wendy and John Bailey’s preliminary hearing was rescheduled for February 15. John Bailey remains jailed on a $100,000 bond, while Wendy Bailey’s bond is set at $1.9 million.
