An urgent warning relating to the use of illegal fireworks has been issued by authorities ahead of the Australia Day public holiday.

SafeWork NSW Acting Deputy Secretary Trent Curtin said there would be heavy penalties for any unsanctioned use of fireworks.

In every state and territory, strict regulations govern fireworks usage, with licensing and permits a broad requirement.

The exception is the Northern Territory, where fireworks can be legally purchased and set off by any adult – but only for a strictly limited period of time on Territory Day in July.

Penalties in NSW are heavy, with unauthorised firework activity – including selling, buying, storing, transporting, and igniting them – subject to a $27,500 fine and 12 months in prison.

“The recent festive season has marked one of the most challenging due to an alarming increase in illegal fireworks activity. Despite the efforts of authorities, there was a noticeable spike in unlicensed and illegal fireworks, which puts public safety at risk,” Curtin said.

“If you handle fireworks without a licence, you risk injuring yourself and others, and there can be serious consequences.”
