Federal judge 'misinterpreted' Alien Enemies Act: Lawyer

() The Trump administration is asking the U.S. Supreme Court to overturn a judge’s ruling blocking the deportation of five Venezuelan nationals using the Alien Enemies Act.

Department of Justice officials claim they are members of the prison gang Tren de Aragua.

Chief U.S. District Court Judge James Boasberg paused their scheduled deportation flights. He said detainees deserve a hearing where they can deny they are gang members.

“I think the (Alien Enemies Act) has been misapplied and misinterpreted by the judge,” lawyer Seth Berenzweig said on ” Now.” “It doesn’t require a formal declaration of war by the U.S. Congress. It requires an invasion of forces that are aligned with a country outside of the United States.”

Berenzweig said he believes this is a “very important case” when it comes to the administration’s efforts to “get a handle on immigration.”
