TikTok influencer Emilie Kiser's husband dodges charges over 3-year-old son's fatal drowning

Influencer Emilie Kiser’s husband, Brady Kiser, will not face child abuse charges in the death of their 3-year-old son.

Trigg, the young son of the TikTok star, died days after he was found unresponsive in a swimming pool at the family’s Arizona home in May.

Last month, it was revealed that Brady, present at his home during the tragic incident, informed investigators he was “distracted” by the couple’s newborn son when Trigg accidentally drowned in their open backyard pool.

After this confession, the Chandler Police Department stated that the investigators suggested Brady face a Class 4 felony charge for child abuse.

However, after a comprehensive review by the Maricopa County Attorney’s Office, authorities decided there was not enough evidence to press charges against Brady.

“Maricopa County Attorney Rachel Mitchell announced today that Brady Kiser will not be charged in the drowning death of his son because there is no reasonable likelihood of conviction,” the Maricopa County Attorney’s Office said in a statement Friday.

“Surveillance video from outside the home showed how the drowning occurred and the actual timeline of events.”

“In order to convict a person of this charge, the state has to prove beyond a reasonable doubt to a unanimous jury that the person failed to perceive a substantial and unjustifiable risk, and that failure to perceive the risk was a gross deviation from the standard of care a reasonable person would show,” the statement went on.

The office noted that every case submitted for review is evaluated on whether there’s a “reasonable likelihood of conviction.”

“After careful review of the evidence submitted by Chandler PD, it was determined this case does not meet that standard,” they added. “Given a court order, no additional details can be discussed at this time.”

The update comes more than two months after Trigg’s death on May 18.

Officials confirmed that the child had succumbed to his injuries following the ordeal, which had left him hospitalized in critical condition on May 12.

On May 27, the social media star filed a lawsuit in Arizona Superior Court for Maricopa County requesting that all records of her son’s death be out of public view — including distressing footage.

The mommy blogger, 26, was out with friends when her son fell into the pool at the family’s home, where her husband discovered the tot unresponsive.

Kiser, who boasts 3.1 million followers on TikTok and over 1 million on Instagram, was propelled to fame after sharing daily videos of her life.

Kiser and her husband, Brady, welcomed Trigg in July 2021. They became parents a second time in March after welcoming their second son, Teddy.
