() Riverside County District Attorney Mike Hestrin lambasted a judge over a decision that kept missing 7-month-old Emmanuel Haro’s father out of prison.

Jake Haro was given a suspended sentence for a separate child abuse case in 2018, allowing him to avoid prison. The victim, Promise Faith, was just 10 weeks old at the time of the abuse and suffered numerous injuries, leaving her permanently bedridden.

“If that judge had done his job … Emmanuel would be alive today,” Hestrin said.

Riverside County Sheriff Chad Bianco echoed the sentiment, saying the baby’s death was “preventable in numerous ways.”

Baby Emmanuel’s parents, Rebecca and Jake Haro, were both formally charged with the murder of their son Tuesday. They were also charged with filing a false police report.

Officials said they believe the child was abused over time and died of his injuries.

“Everybody failed this baby that was close to him,” Hestrin continued.

Officials believe they have a “strong indication” of where the baby’s remains are and said that the parents are cooperating, on some level, with the investigation.

For the time being, the case remains a no-body homicide; however, officials are confident in their ability to get a conviction.

Emmanuel Haro missing since Aug. 14

Emmanuel Haro was first reported missing by his mother Aug. 14. She told police that the baby was kidnapped after she was knocked unconscious while changing his diaper in a parking lot in Southern California.

Last week, deputies announced that the baby is presumed dead and had not been kidnapped.

On Sunday, Jake Haro, wearing a prison jumpsuit, was observed assisting search and rescue teams near the 60 Freeway and Gilman Springs Road in Moreno Valley, as previously reported by .
