HAWTHORNE, Fla. – Kimon Marcus Miller, 36, has been arrested for raping a woman while threatening her with a gun.

The victim, who lives in another county, said she met Miller in March, and on August 22, she agreed to travel to Hawthorne and visit with him. She said that when she got there, they started watching television and she told Miller she did not want to have sex with him.

The victim said Miller got up, picked up a gun, and held it by his side, which made her afraid that he would kill her. She said she agreed to have sex because of this fear, and afterward she begged to leave and call her mother, but Miller wouldn’t let her. When he eventually relented, she quickly dressed but accidentally left her underwear on the floor.

She said Miller instructed her to stop crying and act like nothing happened, then he followed her to her vehicle and took a picture of her license plate; she said he demanded her driver’s license and then took photos of that and said he would kill her and her family if she contacted law enforcement. He told her he had been convicted of fraud and knew how to find out where people live.

The victim fled to a public place and called 911, where Alachua County Sheriff’s Deputies met her and escorted her to a local hospital for a sexual assault examination.

The victim described the exterior and interior of the house, along with the firearm, and she said her underwear would be found in Miller’s bedroom. Miller was arrested on August 23.

Miller has been charged with sexual battery with a deadly weapon and possession of a firearm by a convicted felon. He is on probation for multiple felonies out of Georgia, including aggravated assault with a deadly weapon and possession of a firearm by a convicted felon; although his address is listed in Hawthorne on his arrest report, the Department of Corrections lists an address in Orlando as his verified permanent address.

Miller was last arrested on June 29 for possession of a firearm by a convicted felon and resisting an officer without violence after deputies investigating an armed disturbance found a pistol next to his car. Miller has been charged with possession of a firearm by a convicted felon and resisting an officer without violence. Judge Jonathan Ramsey set bail at $52,500, and he was released on bail. Formal charges were filed in August.

The State Attorney’s office asked Judge James Colaw to hold Miller without bail until trial on the rape charge, and Judge Colaw agreed on August 29. Judge Colaw also set bail at $100,000 on the firearm possession charge.
