Police in New Mexico are investigating the alleged rape of a 12-year-old girl by a fellow student on a Santa Fe charter school bus in August.

Lt. Patrick Trujillo said the girl’s mother called police on August 21 to report the incident, according to the Santa Fe New Mexican. He said the girl was taken to a hospital on the day of the incident.

“It has not been disclosed to me if a rape kit was completed by the hospital, but we do know that the mother did take her daughter to the hospital,” he said.

Trujillo said that the bus did not a surveillance camera, but at least one other student recorded the incident and shared it with other students. Police have seen that video, he said.

“We did speak to some other students. We have collected some additional evidence in the form of cell phones,” Trujillo told KOAT. He described the videos passed around among the students as “sharing underage pornographic images.”

Investigators have seized five cell phones as evidence, the New Mexican said.

Monte del Sol Charter School Head of Learning Zoë Nelsen said the school is also conducting an investigation into the incident.

Trujillo said the bus driver has not been interviewed, despite the incident having taken place a month ago, KOAT reported. The victim has also not been interviewed, but that interview is expected to take place next week.

Trujillo said the alleged rapist is 13 and that no charges have been filed against him or the students who recorded or shared the “underage pornographic images.”
