BROADVIEW, Ill. (WLS) — A judge is expected to issue a temporary restraining order Thursday against the federal government over its use of force against protesters and journalists covering demonstrations at the Broadview ICE facility.

The Department of Homeland Security says protesters blocked ICE agents and ignored orders to move, forcing officers to use pepper balls.

The lawsuit includes NABET CWA Local 41, which represents members of ABC7 Chicago and other local TV stations.

Pastor David Black is also among the plaintiffs. Video from September 19 shows him yelling at officers on the roof before being hit by pepper balls.

One ICE agent can be seen shooting pepper balls at the protesters and one hits Black on the top of his head, which causes Black to fall to the ground, the footage shows.

Black told Religion News Service that he was inviting the ICE agents to repent when the video was recorded.

“I basically offered an alter call,” Black told RNS. “I invited them to come and receive that salvation, and be part of the kingdom that is coming.”

After he was struck by the pepper ball, Black said he could hear the ICE agents laughing.
