Decatur Man's Serious Charge Dropped in Fatal DUI Case: What It Means for Justice

A Decatur man, previously charged with fatally hitting a 12-year-old cyclist while allegedly driving under the influence, has been released from custody after the most serious charge against him was dropped. This decision was announced by the State’s Attorney’s Office.

Macon County State’s Attorney Diane Couri revealed on Wednesday that the aggravated DUI causing death charge against 45-year-old Hassan Woods has been dismissed. After a thorough examination of crash reconstruction, video evidence, and witness statements, it was concluded that Woods’ level of intoxication on the night of June 15 was not the “proximate cause” of the tragic death of young Kavari Drisdell.

The investigation, which also involved the Illinois State Police and the Illinois State’s Attorney’s Appellate Prosecutor Office, corroborated this conclusion, according to Couri.

“This case is profoundly tragic due to the involvement of a child’s death,” Couri expressed, adding, “Our office must act within the confines of the law. Here, legal and ethical standards require us to dismiss the charge of aggravated DUI causing death.”

Court records indicate that the count was dismissed without prejudice, meaning Couri could refile it at a later date.

She added, however, that she will proceed with prosecuting Hassan for count II, aggravated DUI with no valid insurance.

Because of the Pretrial Fairness Act, Hassan was released from custody on Wednesday.

“Again, this is the law of the State of Illinois, and the prosecuting agencies are bound by it,” Couri said. “Our hearts remain with the child’s family and all who mourn this tragic loss.”
