The family of a Southern California man has initiated legal action against Royal Caribbean Cruises, claiming that the cruise line’s crew made a series of negligent choices that led to his death while on board.
This lawsuit, filed this week, concerns the tragic passing of 35-year-old Michael Virgil. He was a passenger on a cruise journeying from San Pedro to Ensenada in December 2024. The lawsuit alleges that the cruise staff excessively served alcohol to Virgil and then resorted to physical restraint when he became disruptive.
Reportedly, Virgil consumed over 30 alcoholic beverages during the trip. His demeanor changed when he struggled to locate his room, leading to a confrontation with crew members.
Kevin Haynes, the attorney representing Virgil’s fiancée, commented, “The footage showing Michael distressed and kicking a door is completely uncharacteristic of him. While his actions were not commendable, they do not reflect his true nature.”
Haynes continued, “Michael was a devoted father, often described as a ‘gentle giant.’ Unfortunately, alcohol can drastically alter behavior, especially in such large quantities. Although his family disapproves of his conduct, they firmly believe it shouldn’t have resulted in his death.”
The lawsuit states that Virgil was also pepper-sprayed and injected with a sedative while he was being subdued.
The death investigation determined he died due to body compression while he was being restrained by multiple personnel and consuming alcohol.
The Los Angeles County Medical Examiner ruled his death a homicide.
After Virgil’s death, Royal Caribbean issued a statement saying that they were saddened by the death of one of their passengers and that they were also cooperating with authorities.
