Maya Hernandez in court with defense attorney Teryl Wakeman on Dec. 15 (Law&Crime).

A trial witness has cast doubt on the initial claims surrounding a California woman accused of leaving her child to perish in a sweltering car while she was at a med spa. The woman, Maya Hernandez, 20, is awaiting a jury’s decision in her murder case. Prosecutors allege that on June 29, Hernandez left her two young sons, aged 1 and 2, in the vehicle while she attended a cosmetic appointment in Bakersfield, California. Tragically, her 1-year-old son, Amillio, succumbed to the intense heat.

During a courtroom session on December 11, a surprising testimony from an aesthetics injector revealed that Hernandez was not there for a lip filler treatment, as previously thought. Instead, she was scheduled for a liquid Brazilian butt lift (BBL), a procedure known to require more time than lip fillers, which typically take 15 to 20 minutes.

The spa employee testified that due to a backlog on the day of Hernandez’s appointment, she was advised to wait in her car until it was her turn. Crucially, Hernandez failed to mention that her children were in the vehicle or that she needed to hurry.

According to courtroom reporting by local NBC affiliate KGET, Hernandez took the stand on Monday in her own defense. During her testimony, she stated that she did not think the BBL procedure would take two hours and believed that it would only take 20 minutes.

Hernandez, in her defense, claimed she monitored her Apple Watch while inside the spa. According to KGET, prosecutors highlighted that she checked the device 45 times, providing clear indications of the passing time. Despite this, she allegedly did not return to the car to check on her children, even as temperatures soared to 101 degrees Fahrenheit.

When Hernandez took the stand in her own defense, she testified that she checked her Apple Watch while she waited inside the spa. KGET reported that prosecutors revealed she checked her Apple Watch 45 times, and that she could have easily seen how much time had passed while she was waiting inside. During that time, she allegedly never went outside to check on the boys while temperatures reached 101 degrees Fahrenheit.

Law&Crime previously reported that Hernandez was told via text by a med spa employee that she was allowed to bring her children inside.

When Hernandez left the spa after her liquid BBL procedure was finished, she told the court that she found Amillio unresponsive in the car and put cold air on him.

KGET reported that while prosecutors showed the court photos of Hernandez and her two boys, followed by pictures from the scene where Amillio died, she cried the whole time.

Hernandez was charged with second-degree murder, manslaughter, and two counts of child cruelty.
