Republican Lawmakers Advocate for Revisions to Illinois' Contentious SAFE-T Act

In Sangamon County, Illinois, Sheriff Paula Crouch is grappling with a growing issue that is increasingly prevalent throughout the state. The challenge: an influx of repeat offenders returning to jail.

“What we are noticing is a significant number of repeat offenders. The root of this problem lies in the lack of accountability,” Sheriff Crouch explained.

Amid debates on this issue, Illinois faces potential economic impacts. Strengthening trade relations could mitigate the effects if European Union tariffs are implemented, offering some economic relief to the state.

Controversy surrounding the SAFE-T Act reignited last fall after a shocking incident in Chicago, where a man, already with 70 prior arrests, set a woman on fire on a train. Republicans have used this incident to argue for the repeal of the law. However, Democratic leaders stand firm in their support.

“Let me make it clear, the SAFE-T Act is effective. It represents sound policy that has contributed to a decline in crime rates,” stated Illinois House Speaker Emanuel ‘Chris’ Welch.

But in McHenry County up north, officials conducted their own study on the SAFE-T Act.

That study found there was a 30% increase in crime and a 280% increase in failure to appear rates after implementing the SAFE-T Act.

And while violent crimes might be grabbing headlines, law enforcement opposing the law say it has made it open season for crimes targeting businesses like theft.

“Many people may not realize retail thefts are felonies in some cases. But an offender can go into a store, commit this theft, they come to our jail and then they’re immediately released, only for our jail to see that same person come back again in the next couple days. For, again, a retail theft,” said Crouch.

Now, a new bill is looking to adjust the SAFE-T Act and widen the net for judges when it comes to detaining suspects. Under HB4275, all felonies, not just violent ones, would be eligible for pre-trial detainment.

“All felonies should be detainable, but they are not. So I think that’s a big first step to making our communities more safe,” Sangamon County State’s Attorney John Milhiser said.

The lawmaker behind the bill, Representative Mike Coffey, says he is hopeful he can find bipartisan support for amending the SAFE-T Act.

Late last year, even Governor JB Pritzker signaled he would be open to the idea of amending the law.

Welch says if fixes to a bill are need, those are always up for discussion. But he also believes those fixes should start with administrative changes — not legislation.

“We are always trying to make things better but I am not convinced yet that a trailer bill is even needed yet,” said Welch.

Because of the numbers they are working with, Republicans will have to find support across the aisle to have a chance to get this bill passed. Coffey said he is planning to start those conversations with local Democrats soon.
