Magistrate Susan Horan accepted Barilaro has recurrent depression, anxiety and post-traumatic stress disorder (PTSD), meaning he will avoid a criminal record after the alleged assault at Manly in July last year.

The court heard Barilaro’s life was spiralling out of control after the death of his father, his resignation from politics, the breakdown of his marriage, fighting the FriendlyJordies defamation case and the fallout from his controversial appointment to a New York trade role.

Barilaro had denied charges of common assault and destroying or damaging property.
