RHOBH's Erika Jayne is Facing a "Lot of Stress" Due to Teddi's Cancer and Lawsuits, Plus Her Attorney Explains Why He Missed Court Hearing in $300,000 Case

Erika Jayne is said to be “dealing with a lot of stress” as she copes with Teddi Mellencamp‘s cancer battle and the many lawsuits against her.

After missing a court hearing concerning a $300,000 lawsuit against the 53-year-old Real Housewives of Beverly Hills star, Erika’s attorney and friend, Jim Wilkes, is addressing the potential judgement against her, offering an update on how she’s been handling things, and discussing her upcoming trial in a separate $24 million case.

“My staff made a mistake. I am in the process of winding down my practice to focus on fewer cases. All I’m going to say now is, ‘Your honor, I apologize.’ I’m going to file a new motion and go from there,” Jim explained to The U.S. Sun on April 7.

According to Jim, he missed the court hearing due to a clerical error and is “fighting all the way” for Erika as he continues to represent her in a case in Florida.

As fans may have heard, Erika is being sued in California and Florida by the designers behind Marco Marco, who accused her of falsely stating that they made up to $900,000 in unauthorized payments to her American Express card. And because Jim failed to show up to the recent court hearing, Erika is now facing a $300,000 default judgment.

“They have no chance. I’m doing everything I know how to do to end this,” Jim said of the matter.

As for Erika’s friendship with Teddi, he continued, “Erika is dealing with a lot of stress. She’s got a close friend that she’s done the internet podcast with who’s got an incredibly difficult health issue … That’s been very difficult for Erika.”

Jim then commented on the $24 million lawsuit filed against Erika by the bankruptcy trustee presiding over Thomas Girardi, 85, and his estate, which is expected to get a trial date in the coming weeks.

“I’m stunned at how Erika has gotten through the depression of it. It astounds me that she’s done such a great job. Erika is good people,” he declared. “I’m glad I was able to help Erika. But I wish I had been in California, close enough to do more.”

“They’ve got a trial set up, they wanna do with Erika, but we’ve seen in the state court cases, they’ve gone through it, and there’s no evidence. And the judge said that he sees no evidence Erika was involved in anything,” he added.
