Kanye West will be grilled under oath over claims he discriminated against and harassed a former Black employee, as he fights off rumors his marriage to Bianca Censori is over, In Touch can exclusively report.

On February 11, according to court documents obtained by In Touch, a Los Angeles judge ruled that Ye, 47, must appear, in person and not via Zoom, for a deposition as part of the lawsuit brought by Benjamin Deshon Provo.

Benjamin has been attempting to lock down a date to depose Ye for months. He requested sanctions due to Ye not appearing for a “properly-noticed deposition” and failing to provide alternative dates.

As In Touch first reported, Ye parted ways with his previous legal team last year and had been without representation until last month.

Ye’s new lawyer, Eduardo Martorell, opposed Benjamin’s motion to compel Ye to appear for a deposition and sanctions.

He said they had worked out a date for Ye to be deposed on April 29.

Benjamin told the court that Eduardo had misrepresented the deal and never signed a stipulation over Ye’s deposition as allegedly promised.

Benjamin’s lawyer said he “anticipates that Ye and/or his counsel may try to avoid producing him for deposition, or, in the alternative, require that his deposition be conducted virtually.”

The lawyer added, “However, based upon [Benjamin’s] knowledge of Ye’s conduct during depositions in other matters, including, making a mockery of those proceedings by wearing a Halloween mask, and engaging in conduct that otherwise would be inappropriate for such proceedings, [Benjamin] requests an order that he be ordered to appear in person.”

At the recent hearing, the judge ordered Ye to be deposed, in person, on or before April 29.

The court also awarded Benjamin sanctions in the amount of $500, which Ye has 30 days to pay.

As In Touch first reported, Benjamin started work as a security guard at Ye’s Donda Academy in 2021 after meeting Ye through a mutual friend.

He said over time he was given responsibilities at Ye’s Sunday Service and at the warehouse “where [Ye] stored his Yeezy wear.”

In his bombshell lawsuit over alleged discrimination and wrongful termination, Benjamin claimed Ye openly expressed his displeasure with Black authors.

The complaint claimed, “Specifically, in or around mid-2023, Kanye required that anyone associated with Donda dispose of books related to Martin Luther King, Jr., Malcolm X, and other prominent figures in the Black community. Further, Kanye regularly expressed negative beliefs associated with prominent Black leaders that advocated for or sought to advance the Black community. Such offensive opinions were particularly troubling to [Benjamin], who is unapologetically Black.”

Benjamin claimed “in the years” that he reported to Ye, he noticed a stark difference in how Ye treated “[Benjamin’ and other black employees, in relation to his non-Black counterparts.”

The suit added, “While Kanye was polite and attentive to his non-Black counterparts, Kanye was always abrupt, abrasive, and demeaning of [Benjamin] and his Black counterparts.”

Benjamin claimed he was paid less than his non-Black counterparts for no discernible reason. On top of that, he claimed he was discriminated against due to him wearing dreadlocks because of his Muslim faith.

He claimed in April 2023, Ye “unjustifiably and unreasonably began demanding that [Benjamin] and others shave their heads.” Benjamin said he objected. Benjamin said Ye and other bosses tried to pressure him more, but he refused, and was allegedly terminated as a result.

Ye and his company denied all allegations of wrongdoing. Lawyers for the defendants argued, “The alleged conduct of Defendants was at all times undertaken in the good-faith exercise of a legitimate business purpose.”

Ye’s legal team added, “Defendants are informed and believe, and based on such information and belief allege that Defendants were justified in doing any and/or all of the acts alleged in the Complaint.”

Earlier this week, TMZ reported Ye had split with Bianca, 30, and met with divorce lawyers. Ye’s rep Milo Yiannopoulos denied the report in a statement to The Hollywood Reporter.

“Ye and Bianca are in Los Angeles, about to enjoy Valentine’s Day together. Announcements about their private life will come from them directly, not unsourced rumor in the tabloid press,” Milo said. “Is this the fifth or is it the sixth time the press has wrongly reported that Ye and Bianca are separating? I’ve lost track.”
