Real Housewives of Atlanta alum Kim Zolciak’s daughter Ariana Biermann avoided jail time and had her DUI charge reduced as part of a plea deal in court, In Touch can exclusively report.
According to court documents obtained by In Touch, a hearing was held on May 23 in Ariana’s criminal case over her 2022 arrest for driving under the influence.
The reality star denied she had been drinking before she drove, but admitted smoking a THC vape the night before.
Per the plea deal, Ariana, 23, pleaded guilty to reckless driving and possession and use of drug related objects. The other charges, including the DUI charge, were dropped by prosecutors.
Ariana will serve 24 months of probation, per the filing.

The court warned her that any violation of her probation could result in her being thrown in jail. She was told to obey all laws, avoid drugs and drinking excessively and to report to any probation officer as directed.
In addition, the order states Ariana shall produce “from time to time” upon request from her probation officer, a law enforcement officer or other official a breath, saliva, urine or blood specimen for analysis for the presence of drugs including alcohol.
Ariana was also ordered to pay over $2,000 in fines, perform 40 hours of community service, not drink alcoholic beverages or use drugs unless prescribed, complete an evaluation for substance abuse and take a Victim Impact program.

The court said the probation could terminate early once Ariana completes all requirements and pays all fines.
As In Touch first reported, back in early 2024, Ariana was hit with six misdemeanor charges over her arrest that went down on August 13, 2022.
The criminal charges included driving under the influence of multiple substances, driving under the influence of alcohol, possession of drug related object due to her “unlawfully” possessing a vape pen with THC cartridge, improper turn, failure to obey signs or control devices and underage possession of alcohol.
On the night of her arrest, Ariana was booked on three charges of driving under the influence, misdemeanor improper lane change and underage alcohol possession.
As In Touch previously reported, the arrest came after officers pulled over Ariana after she hit another vehicle.

The reality star’s boyfriend, Hudson McLeroy, was a passenger in the car. Ariana told police that she did not drink alcohol before getting behind the wheel. The officers claimed to have smelled alcohol on her breath.
At the scene, Ariana told officers she had smoked a THC vape “the night before” but was adamant she did not consume alcohol. During a field sobriety test, officers claimed Ariana had a “noticeable sway.” Ariana was arrested and released on bond the same day.
Following her arrest, Ariana’s lawyer, Justin Spizman, said, “Ariana was involved in a minor fender bender. When police arrived on scene, the investigating officer immediately initiated an investigation for DUI. Despite Ariana’s constant invocation that she was upset and anxious from the minor accident, the officer incorrectly concluded she was impaired by alcohol. That was not the case. She wholly denies these allegations and intends to fight these charges because she is not guilty of them.”
As In Touch first reported, prior to the plea deal, Ariana and her legal team were preparing for a potential trial.
Ariana’s lawyer demanded all evidence from the “unlawful seizure” of his client be barred from being used in the case. He argued, “At the time of [Ariana’s] initial detention … sufficient facts did not exist to support even an articulable suspicion that [Ariana] was under the influence of alcohol or drugs, or that any other criminal activity was underfoot.”

Ariana’s lawyer added, “Specifically, [Ariana] committed no traffic violations prior to be detained by law enforcement.” He continued, “[Ariana] further shows that this initial detention was an unlawful warrantless seizure, not supported by probable cause or articulable suspicion, violating [Ariana’s] rights under the Fourth Amendment to the Constitution of the United States.”
Kim, 47, spoke out about her daughter’s arrest following her release from jail. “Since she was being cooperative and honest, she admitted to consuming marijuana the day before, meaning over 24 hours prior to her contact with the law,” Kim said.
The Real Housewives of Atlanta alum added, “In addition, the arresting officer, as evidenced by his own police report, charged Ariana with impairment by alcohol. She wholly denies these allegations and intends to fight these charges because she is not guilty of them.”
Ariana starred on Bravo’s RHOA and her family’s spin-off show, Don’t Be Tardy.
This week, the network launched a new show, Next Gen NYC, starring Ariana and several other children of Real Housewives stars.
As In Touch previously reported, Kim and her estranged husband, Kroy Biermann, are still in the middle of finalizing their extremely bitter divorce.
Kroy adopted Ariana and her sister, Brielle Biermann, who Kim had from a previous relationship, in 2013.
