Kellie Pickler demanded her late husband Kyle Jacobs’ parents pay restitution and return assets owned by Kyle, days after they asked for her to be found in contempt, In Touch can exclusively report.

According to court documents obtained by In Touch, Kellie, 38, asked for permission to bring additional claims against Kyle’s parents, Reed Jacobs and Sharon Jacobs, in their never-ending court war over Kyle’s property.

In her new motion, Kellie said she wants to file an amended petition seeking recession and restitution against her former in-laws.

Kellie said she wants the court to rule she is the “sole beneficiary of” Kyle’s estate and that “all personal property, funds and assets of any kind belong to belonging to” Kyle “at his death should be distributed in full” to her.

The singer said Reed and Sharon “may have already distributed items or assets to themselves (or others) or expended estate funds.”

Kellie, who started dating Kyle in 2008 and wed him in 2011, has been fighting Reed and Sharon Jacobs for months.

Kyle, a successful songwriter, died on February 17, 2023, from a self-inflicted gunshot wound at the age of 49. At the time, Kellie declined to take over as administrator of Kyle’s estate, despite being first in line for the role due to her being his wife.

Reed and Sharon were put in charge after Kellie declined. His parents fired off a subpoena to Kellie demanding she return a bunch of Kyle’s property.

The property includes Kyle’s gun collection, gun safe, several expensive watches, a 1957 Gibson guitar, a McPherson KOA guitar, a bin of baseball cards, military challenge coins, his iPhone, work laptop, hard drives, his grand piano, viola and various other items he left behind. Kellie filed her own petition asking the court to intervene in the dispute.

She admitted “a dispute has arisen amongst the parties regarding certain personal property allegedly [Kyle’s] possession prior to his death.”

Reed and Sharon argued the property in question “indisputably belongs to the estate.”

Kyle’s parents recently asked that Kellie be found in contempt of court for refusing to comply with the subpoena. Kellie fired back at the request claiming the subpoena was not signed off on by any court.

She said the fight over the property should be heard as part of her petition, not in probate court.

In her proposed amended complaint, Kellie said after Kyle’s death she “cooperated with the Jacobs and facilitated the delivery of truckloads of items” to them.

She said Reed and Sharon continued to make demands for more items. Kellie claimed that ownership of the items demanded by the Jacobs was governed by agreements executed by Kyle and her.

“Those agreements are binding upon the Estate, the Jacobs, individually and in their fiduciary capacities and their counsel,” she said.

Kellie said she filed a straightforward petition to address their dispute “via the least contentious legal avenue available.”

Her lawyer said despite Kellie’s efforts, the Jacobs have “insisted in a course of conduct that has breached the parties’ agreements and which conduct has caused and threatens to cause further serious damage to [Kellie].”

In addition, she claims they included her private email and other sensitive information.

Kellie said on March 4, “at least one” of her personal emails was hacked, “and she was the target of cruel harassment and compromise of her security.”

The singer said, “As a result of the Jacobs’ breaches, [Kellie] has been denied the benefit of her bargain of privacy, confidentiality and protection with respect to the parties’ agreement.”

Kellie asked that the court rule she is the sole owner of Kyle’s property.

She also wants a full and complete accounting of the administration of Kyle’s estate and the appointment of an administrator ad litem, along with “suspending and revoking the Jacobs’ letters of administration, which requests [Kellie] intends to submit to the court in the estate.”

Further, she said “to the extent that Jacobs’ have already distributed estate assets or expended estate funds, [Kellie] seeks that this court impose a constructive trust on those assets/funds against the Jacobs and order the Jacobs to return those assets/funds to the estate, as part of [Kellie’s] request for rescission and restitution.”

Kellie also asked that her petition be sealed, but the judge has yet to rule.
