A tattoo artist was made to cough up thousands of dollars after she painfully inked a man’s nipple, a tribunal heard.
Franky Berto got a refund and a $1,150 compensation pay out after he took Darwin Lelei Ink owner Leah Kathleen Tilini to the NT Civil and Administrative Tribunal last year.
Mr Berto claimed the 35-year-old charged him $1,600 to etch a lion’s head tattoo of his own design onto his torso – but as the wounds healed he saw ‘significant errors’ in the work she did.
He said he was completely dissatisfied with the service claiming she changed 80 per cent of the original design while being distracted on the job.
‘During my two-hour tattoo session the respondent was continuously interrupted by multiple phone calls and a child running into the studio,’ Mr Berto said.
Franky Berto said he specifically discussed before the session began that tattoo artist Leah Tilini would leave the nipple area alone as it was a very sensitive part of the body (pictured, the tattoo done by the Darwin artist)

He added he did not consent to her doing free hand design.
‘I had experienced significant pain during my tattoo and realised later the respondent tattooed my nipple.’
He said they discussed before the session began that she would leave the nipple area alone as it was a very sensitive part of the body.
‘During the healing period, I discovered significant errors compared to my original tattoo design,’ he added.
He said he tried to reschedule a time for her to fix the mistakes but she ‘deliberately ignored’ the requests so he was forced to demand a refund.
NTCAT senior member Andrew Macrides ordered Ms Tilini to pay the refund in full and to fork out another $1,150 for Mr Berto to have it fixed.
Mr Macrides said he had no reason to doubt the accuracy of Mr Berto’s claims and agreed Mr Tilini had not responded to his attempts to rectify the ‘poor tattoo service’.

He said she failed to fix the tattoo errors and to put right her breach of the consumer guarantees.
The tattoo artist did not file a response and was not present at the tribunal.
Meanwhile, Ms Tilini refuted Mr Berto’s claims they had agreed to avoid his nipple area and that he didn’t want her to do free hand patterns.
‘He was fine with the nipple part being tattooed although I have no proof of that conversation,’ she told Daily Mail Australia.
‘And he agreed for me to do free hand patterns.’
The mum of six said the pair discussed inking the tattoo with a stencil as well as free hand which she has done more than 50 times in her five-year career.
‘A friendly sit down conversation was had outside of the studio, once the session was completed there were no issues,’ she added.

‘He was even speaking with excitement about his second session.’
She said another appointment had to be made to complete the job because he was in too much pain to continue.
Ms Tilini said she didn’t ignore his texts messages but claimed he was angry he couldn’t meet her at the time he was in town.
She conceded she may have been interrupted to change the music at ‘one or two points’ during the appointment but denied any children ran into the store.
