Following his retirement, his place will be fulfilled by Judge Ketanki Brown Jackson by taking the prescribed oath. She will be serving as the 116th member of the court. He got associated with the supreme court in 1994.

Breyer attended Stanford University before enrolling as a Marshall Scholar at the University of Oxford and receiving his law degree from Harvard in 1964.
The judge served as a law professor and lecturer at Harvard Law School from 1967 to 1980 after completing a clerkship with Associate Justice Arthur Goldberg in 1964–1955. In addition, he wrote textbooks on administrative law that are still in use today.
