3 Kids Charged in Fatal – and Intentional – New Mexico Hit-and-Run

A 13-year-old New Mexico boy has been charged with murder after a police found cell footage of him driving a car and intentionally hitting a bicyclist on the road, killing him.

Johnathan Overbay was 12 when he rammed 63-year-old Scott Habermehl on May 29, 2024, KRQE reported.

Albuquerque Police also took an 11-year-old boy, identified as Messiah Hayes, into custody for the incident and are looking for a third boy, identified as William Garcia, now 16 but was 15 at the time, KOB reported. Hayes is too young to be charged with murder, police said, and they are working with prosecutors to determine what charges he will face.

Garcia will face a murder charge and, like Overbay, who was 12 at the time, leaving the scene and other related charges.

Police released the video, shot by Garcia from the back seat of the stolen car, this week. Overbay was driving the vehicle, and Hayes was in the front passenger seat with a gun.

Police said they’d initially closed the case, thinking it was an accident, but then someone pointed out the video posted to social media.

In the video, which stops just before the fatal strike, Garcia tells Overbay to “just bump him … Go like 15-20.” KQRE said. The 11-year-old in the front seat is waving a gun and laughing.

They car Overbay was driving was reportedly stolen.

KOB said Hayes and Overbay had extensive criminal histories, including robbery, property damage, and more. But neither had been held in custody for any length of time.
