In Washington state, a federal prosecutor, who briefly held the position of U.S. attorney before being swiftly dismissed by President Donald Trump, has taken legal action to contest his termination.
Just last week, a panel of district court judges reached a unanimous decision to appoint Roger Rogoff as the head of the Western District of Washington. A seasoned Seattle prosecutor, Rogoff was selected to cover a role left unfilled by both the 45th and 47th president. Yet, in under an hour, Trump thwarted the judges’ determination with an email delivering Rogoff’s dismissal.
Now, a detailed 24-page complaint argues the president’s sudden removal of the prosecutor was “unlawful,” according to the legal representatives backing Rogoff.
The lawsuit also suggests that Trump’s interference threatens to perpetuate instability in the Western District, preventing Rogoff from assuming the role to which he was properly appointed.
“U.S. Attorneys have a statutory duty to prosecute all federal offenses within the district and to prosecute and defend, for the federal government, all civil actions in which the United States is concerned,” the lawsuit goes on. “By preventing Mr. Rogoff from fulfilling the duties lawfully entrusted to him, Defendants’ actions are causing immediate and severe harm to Mr. Rogoff and the public interest.”
The plaintiff is seeking an injunction returning prosecutorial powers and duties to him and barring the Trump administration from impeding him “from accessing any of the benefits or resources of his position.”
