GAINESVILLE, Fla. – Henry Gomez, 25, has been sentenced to 60 days in jail, followed by six months of community control and 42 months of probation, after entering a plea of nolo contendere to two counts of video voyeurism.

According to a sworn complaint filed in the case, Gomez, who worked at the Walmart on NW 23rd Street, went into the store’s optical shop on both May 10 and May 13 of 2023 and asked the optician to show him some glasses frames. While the optician was reaching for frames, Gomez positioned a cell phone under her dress while pretending to look at lower shelves or tie his shoes; he did this several times during each visit. He also put the phone on the floor at an angle in an attempt to capture video under the victim’s dress and also placed the phone in his lap for the same purpose.

The victim became aware of the placement of the phone and provided video of the incidents to Walmart security staff and law enforcement officers.

Gomez was arrested in July 2023 and was released after two days on $100,000 bond. In February, he filed an open plea of nolo contendere to two counts of video voyeurism, which carry a maximum sentence of 10 years in prison. On April 24, Judge Phillip Pena accepted the plea and sentenced Gomez to 60 days in jail with credit for two days served, followed by 6 months of community control (house arrest), followed by 42 months of probation. He is prohibited from entering any Alachua County Walmart while he is on probation.
