A Wisconsin father who said his 4-month-old son suffered severe injuries after falling from a bed was convicted after a jury rejected his account.
David Schmies, 27, was found guilty of physical abuse of a child on Oct. 14, nearly five years after his infant son was hospitalized with broken bones and a head injury. According to a previous Law & Crime report, Schmies was stepping out of the shower when a relative discovered the baby with a swollen head. Schmies reportedly responded, “Yeah, he’ll be fine.”
When the relative pressed him for an explanation of what had happened, Schmies reportedly began to cry.

The child survived. Schmies was charged with abusing his son in February 2022. Following multiple delays and the rejection of a plea agreement, the case went to trial on Oct. 12. Jurors deliberated for approximately three and a half hours before reaching a guilty verdict, according to the district attorney’s office.
Schmies is scheduled to be sentenced on Dec. 8.
