Florida Man Allegedly Targets Ex with Backpack of Waste in Cheating Accusation Drama

A troubling incident unfolded in Florida, where authorities claim a man took drastic measures against his ex-girlfriend, allegedly hurling a backpack filled with feces and urine at her, driven by his suspicion of her infidelity.

Daniel Niemiec, a 20-year-old resident, is now facing serious charges of domestic violence, including strangulation and two counts of battery. These charges stem from a disturbing series of accusations reportedly affecting the woman over the span of a month, as detailed in a probable cause affidavit obtained by Oxygen.

According to court documents, the ordeal began on June 2nd during an initially consensual encounter when Niemiec allegedly began repeatedly hitting her face with his hand. Despite the woman’s pleas for him to cease, the alleged assault continued, leaving visible marks and pain, which she captured in photographs and later shared with her mother.

The situation reached a dangerous level on the night of June 30th. An argument at Niemiec’s home reportedly escalated when he approached the woman in the living room, placing his hands around her neck. According to the affidavit, he allegedly choked her, severely restricting her ability to breathe and causing her to gasp desperately for air.

Investigators noted in their report that the victim attempted to cry out for help during the attack, but her voice was stifled due to her obstructed airway, leaving her unable to vocalize her distress, as the authorities detail.

According to the woman’s account, Niemiec was allegedly laughing as he choked her.

After the incident, she went to a friend’s Margate home, then returned the following day to collect her personal belongings. As she arrived at the residence, Niemiec was allegedly standing outside holding her backpack, which he’d “defecated on, urinated on” and “filled with hot sauce, ketchup and other unknown fluids” and dumped it over her, authorities said.

The woman left the area and eventually contacted police to report the alleged abuse. The reporting officer said she was “physically shaking” and appeared to be “in fear” while recounting the incidents.

After taking Niemiec into custody, police said he admitted to the slapping incident, telling officers that he was trying something new during the consensual sex and it “had gotten out of hand,” per the affidavit. 

When asked about the strangling incident, police said Niemiec told investigators that he had “anger issues and sometimes cannot control it,” while admitting to placing his hands around his girlfriend’s neck and applying pressure. He added that he “didn’t think” his girlfriend would have been able to breathe, according to the court records.

When the conversation turned to the backpack, Niemiec told investigators that he had been “upset” because he thought his ex was cheating on him and filled the backpack with feces, urine and other fluids as “payback for her cheating,” according to the affidavit.

He told investigators that he threw the backpack at her in the parking lot, but didn’t remember where it landed.

Niemiec was later released from custody and placed on house arrest, according to court records reviewed by Oxygen. 

It’s unclear whether he has retained an attorney.
