Rex Heuermann, accused of the notorious Gilgo Beach murders, is now seeking a dismissal regarding the 1993 killing of Sandra Castillo.
As reported by the Massapequa Post, Heuermann’s legal team has filed for the dismissal of the second-degree murder charges. This request was made earlier this month during a hearing presided over by Justice Timothy Mazzei at the New York State Supreme Court. Read more here.
CrimeOnline previously highlighted that in July 2023, authorities apprehended Heuermann in Manhattan in connection with the murders of Melissa Barthelemy, Megan Waterman, and Amber Lynn Costello, which occurred in 2009 and 2010.
By June 2024, Heuermann faced charges for the murders of Costilla and Jessica Taylor. Later, in December 2024, he was indicted for Valerie Mack’s murder.
The push for dismissal in Castillo’s case stems from the prosecution’s reliance on a single hair discovered on her clothing, which they claim ties Heuermann to the crime.
Heueremann’s defense team contended that the evidence is not “legally sufficient to establish the offense charged or any lesser included offense.”
Suffolk County District Attorney Ray Tierney told the court he planned to oppose the motion.
Mazzei gave the prosecution until March 3 to respond. The defense will have until March 17, Patch reports.
“There are some real significant issues that they’re bringing to the court’s attention,” defense attorney Michael Brown said, following the hearing.
Mazzei expects that the “trial will begin after Labor Day…come hell or high water.”
