GAINESVILLE, Fla. – In a troubling incident on December 25, 23-year-old Travius Markell Davis was taken into custody and charged with sexual battery. The arrest followed allegations from a woman who claimed Davis, with whom she was in the early stages of a relationship, had assaulted her.

The alleged victim recounted that she had permitted Davis to enter her residence around 4:30 p.m. on December 24. Unbeknownst to her, Davis reportedly followed her into her bedroom, shutting and locking the door behind them.

According to the victim’s statement, when she confronted Davis about his actions, he allegedly overpowered her, placing her on the bed and raping her despite her efforts to fend him off and escape.

Following his arrest and after being informed of his rights, Davis reportedly claimed that he perceived the victim’s body language as consenting, despite her lack of verbal confirmation. He acknowledged that during the encounter, the victim had a pillow over her face. Davis admitted to the intercourse and confessed to sending apologetic messages afterward, expressing regret for advancing their relationship too quickly.

Post Miranda, Davis reportedly said the victim did not reply when he asked her if she wanted to have sex, and he interpreted her body language as consent, although he said she held a pillow over her face during the sexual encounter. He reportedly admitted to engaging in intercourse with her and said that after he left, he sent her texts to apologize for rushing their relationship.

Davis has been charged with sexual battery. He has no local criminal history. Judge Julie Johnson ordered him held without bail pending a hearing on a motion from the State Attorney’s office to hold him without bail until trial; if the judge denies the motion, bail will be set at that hearing.
