Man Experiencing Homelessness Detained Following Attempted Break-In at Occupied Residence

GAINESVILLE, Fla. – A curious and alarming incident unfolded last night in Gainesville, resulting in the arrest of a 30-year-old man named Moise Beltschatsar Delva. Delva is accused of attempting to force his way into an apartment that was occupied at the time.

The unsettling episode took place around 9:24 p.m. at the 39th Avenue Apartments located at 1101 NW 39th Avenue. According to the resident, the individual in question initially tried to open her front door. Unsuccessful, he proceeded to the side of the apartment, entering an enclosed patio. There, he made several attempts to force open the sliding glass door. When this too proved futile, he allegedly shifted his focus to the bedroom window, attempting to pry it open.

Frightened by the intruder’s persistence, the resident sought refuge in her bathroom. Meanwhile, she heard him once more trying to access her front door, before he returned to the patio. It was at this critical moment that the Gainesville Police Department officer arrived on the scene, leading to Delva’s arrest.

Following his arrest, Delva was read his Miranda rights. He reportedly explained that the night’s events were the result of drinking excessively and wandering behind a house. He claimed his actions were merely a consequence of being homeless and seeking shelter. Delva also alleged that he mistook the apartment for what he referred to as a “trap house,” a term used to describe a location where drugs are sold. He denied entering the enclosed patio, insisting the sliding door was already ajar. However, the officer’s observations contradicted this, noting that the sliding door could only be accessed from within the patio. When informed of the burglary charges, Delva responded by asserting that he was “just trespassing.”

The victim said she had never met Delva and never gave him permission to enter her apartment.

Delva, whose address is listed as Homestead and is described as homeless on the arrest report, has been charged with attempted burglary of an occupied dwelling. He has arrests in Miami-Dade County for battery, indecent exposure, selling drugs, child abuse, trespassing, contributing to the delinquency of a minor, and strongarm robbery and at least one arrest in Georgia; he has served one state prison sentence and was released in 2019. Judge Jonathan Ramsey ordered him held without bail pending a hearing on a motion from the State Attorney’s Office to hold him without bail until trial; if the judge denies the motion, bail will be set at that hearing.
