Marilyn Mosby, the former state attorney for Baltimore City, was spared prison time on Thursday, but her vacation house in Florida had to be forfeited.

Judge Lydia Griggsby sentenced the defendant to two years of supervised release after 12 months of home confinement. Mosby will have to perform community work as well.

The decision follows Mosby’s conviction for perjury and mortgage fraud by two other juries.

The CARES Act outlines specific requirements for qualifying withdrawals, such as a reduction in income due to a COVID-related layoff or due to quarantining. On January 13, 2022, a federal grand jury indicted Mosby on a charge of perjury, claiming she had falsely claimed financial hardship related to COVID-19 in order to request one-time withdrawals of $40,000 and $50,000 of her deferred compensation funds. However, she had reportedly continued to draw her full salary during the period and had even seen an increase in pay.

She was also charged with falsifying information on her mortgage applications for her condo and house in Florida by omitting to include her federal tax obligations.[6] The indictment contained four charges.

The prosecution successfully alleged that Mosby lied on a mortgage application and took $90,000 from her city’s Deferred Compensation Plan under false pretenses to purchase two vacation houses in Florida.

Judge Lydia Griggsby concurred with the government that if Mosby hadn’t submitted a fictitious $5000 gift letter from her now ex-husband Nick Mosby, she wouldn’t have been approved for a mortgage loan.

Mosby will be able to retain the increased value of her initial 10% down payment on the house as part of the decision. Redfin assesses the home’s current value at $886,000. The original purchase price was $428,000. Mosby’s attorneys anticipate requesting a stay from Griggsby so they can file an appeal.

Mosby might have spent as much as 40 years in prison. The prosecution asked for a 20-month prison sentence.

Griggsby concurred with the defense’s recommendation of probation rather than jail time, pointing out that Mosby’s offense was non-violent and mentioning that she was a mother of two young girls.

Mosby’s team has been pursuing a presidential pardon through a nationwide media blitz over the last few weeks.

Mosby says she was unfairly convicted and politically singled out.

 

Who Is Marilyn Mosby?

 

Marilyn Mosby born January 22, 1980, is an American politician and lawyer who served as the State’s Attorney for Baltimore from 2015 to 2023.

After Freddie Gray was killed in 2015, Mosby became well-known across the country. She oversaw a widely reported inquiry and failed to convict the police officers who had detained and taken Gray.

Mosby was reelected in 2018 but lost to Ivan Bates in her 2022 reelection campaign after being indicted on accusations of perjury and mortgage fraud in January 2022 by a federal grand jury.

Mosby was charged when it was alleged that she had taken money out of a program meant to assist those who had been negatively impacted financially by the COVID-19 outbreak.

Mosby entered a not-guilty plea and denied any wrongdoing, but on November 9, 2023, he was found guilty on two counts of perjury and on February 6, 2024, on one count of mortgage fraud.

James got married to current Baltimore City Council President Nick Mosby in 2005. Their two girls are there. They reside in Baltimore’s Reservoir Hill area.

Since then, she has gone by Mosby in her professional life.

The Mosbys filed for divorce on July 21, 2023.
