An Ohio man convicted of striking his infant and attacking the child’s mother while she held the baby has been sentenced to two months in jail, followed by probation. Avery Mapes, aged 23, entered a no-contest plea to several charges stemming from the incident.
In a court decision last month, Mapes pleaded no contest to child endangerment. His domestic violence charge was downgraded to negligent assault due to his plea agreement. As part of the deal, charges of assault, obstruction, and disorderly conduct were dropped. Mapes received a 60-day jail sentence for the negligent assault and a year of probation for the child endangerment conviction, court records reveal.
Law enforcement apprehended Mapes on December 4, 2025, following an alleged attack on his fiancée and their infant child. The altercation occurred while Mapes was reportedly intoxicated. The child’s mother bore visible injuries, and the baby suffered noticeable red marks and bruising from the assault, as documented in court files.
After the incident, the family sought medical attention at a nearby hospital. There, Mapes reportedly became aggressive, attempting to bite police officers and continuing his hostile behavior, according to police reports.
The probable cause statement for his arrest detailed that Mapes was in a state of rage, hurling racial slurs, and causing a disturbance within the hospital room. Initially, he faced charges including assault, child endangerment, domestic violence, obstruction, and disorderly conduct due to his alleged actions.
“The defendant attempted to strike the mother of the child multiple times while she held the 6-month-old and instead struck the child at least once,” police alleged.
When cops first arrived at the couple’s Toledo home, they found Mapes’ fiancee with “bloody handprints” on the back of her hoodie, according to court documents.
“She had bruising and red marks on her forehead and upper right area,” the probable cause statement said, noting how Mapes allegedly ran at his fiancee before unleashing his attack. “It appeared as if her arm had been squeezed,” the statement added.
While at the hospital, Mapes was handcuffed to a bed, which he allegedly dragged around his room in an attempt to assault officers. He attempted to “kick and strike” medical staff members and “continued to yell racial slurs and profanities” while at the facility, police alleged.
“The defendant refused to follow commands,” court documents said.
Mapes was released on his own recognizance after the incidents with an electronic monitoring device and was ordered to stay away from his fiancee and child.
