GAINESVILLE, Fla. – Andrew Glenn Shaffer, 19, was arrested last night and charged with sexual battery after allegedly encouraging the victim to drink shots and then raping her in his dorm room while she was unconscious.
A University of Florida Police Department officer reported that on September 24, Shaffer brought the victim to his dorm room at Honors Village after she’d had three to five shots of an alcoholic beverage. The victim told the officer that Shaffer encouraged her to drink alcohol while they were out, and when Shaffer asked her if she wanted to have sex, she said no.
She said she went back to his dorm room and lay down in his bed, where she fell asleep and became unconscious, due to her level of intoxication. She said she was confused when she woke up and found that she was wearing Shaffer’s shirt and her own clothing was in disarray. She said Shaffer asked her if she was going to get a Plan B pill, and she asked him what he was talking about. She said she didn’t believe Shaffer at first when he said they’d just had sex because she did not remember it.
The victim reportedly showed the officer Snapchat messages in which she asked him if he pulled out, and Shaffer responded, “I don’t think so.” When she asked if he wore a condom, he reportedly replied that there was no wrapper in his room. Shaffer reportedly admitted to the victim that he knew she’d said no, that what happened wasn’t right, and he should have been more aware of “the state they were both in.” Shaffer reportedly paid the victim $50 via Venmo to pay for an emergency contraceptive because he was nervous that she would get pregnant; the officer reported that the victim showed him the Snapchat messages discussing the payment and a screenshot of the Venmo payment.
Post Miranda, Shaffer reportedly admitted to having sex with the victim but said it was consensual; he said he couldn’t remember a lot of the things that had happened that night, but he reportedly changed his story when he was shown the Snapchat messages and confirmed that he had sent them.
Shaffer has been charged with sexual battery of a physically helpless victim. He has no local criminal history, and Judge Aymer “Buck” Curtin ordered him held without bail pending a hearing on a motion from the State Attorney’s office to hold him without bail until trial; if the judge denies the motion, bail will be set at that hearing.
