Cops Recommend Felony Charges Against Influencer’s Husband in Toddler Son’s Drowning Death

Arizona prosecutors announced last week that they will not be charging a man whose 3-year-old son drowned on their property in May.

Maricopa County Attorney Rachel Mitchell said it is unlikely that Brady Kiser will be convicted if he were to stand trial for Trigg Kiser’s drowning death. The Arizona Republic reported that Trigg Kiser died on May 18, days after he was found in his family’s backyard pool in Chandler.

Brady Kiser was reportedly watching his newborn and toddler sons on May 12 when he discovered the older boy floating in the pool.  The father allegedly said he was watching his newborn son when he lost track of the 3-year-old for up to five minutes.

Chandler police previously said they were considering charging the father with felony child abuse. Court records indicated that police mulled criminal charges before the toddler’s death.

However, Mitchell said she and “highly experienced senior” prosecutors who reviewed the case determined it would be difficult to prove criminal negligence on Brady Kiser’s part.

Brady Kiser was reportedly watching his two sons while his wife, social media influencer Emilie Kiser, was out with friends. He claimed he saw the toddler playing near the pool, which was “not uncommon.” He also said a protective cover was typically over the pool.

The boys’ mother, Emilie Kiser, has more than 4 million followers on TikTok. On May 27, she filed a lawsuit to keep information about Trigg Kiser’s death withheld from the public. The family’s lawyer wrote that they “desperately want to grieve in private, but sadly, the public will not let them.”

On June 3, a judge barred Chandler and Maricopa County officials from disclosing records until lawyers reviewed the documents.
