PORT ORANGE, Fla. – The 70-year-old driver involved in a crash that killed a fourth-grade student near Sugar Mill Elementary School last year will not be charged, Port Orange police said.

In May, 9-year-old Shaolan Kamaly was riding her bike in front of the school. Officials say she was in a crosswalk when she was hit.

In a news release obtained by News 6 Tuesday, Port Orange police said the investigation into the fatal crash has been completed. Law enforcement had reviewed all available evidence and determined the “driver of the vehicle had not been operating her vehicle in a wanton or reckless manner.”

“Speed was determined not to be a factor in this crash. However, the driver was cited for failing to exercise due care toward a pedestrian in a crosswalk under Florida State Statute 316.130 (15). Our hearts remain with the victim’s family and friends, as well as the entire Sugar Mill community during this difficult time,” the release states.

News 6 has decided not to name the driver because she has not been formally charged.

Following Kamaly’s death, Volusia County schools rolled out new safety changes at the start of the 2024-2025 school year, including pedestrian signs, speedbumps, and more traffic control officers.
