FSU shooting case: Defense yet to file for discovery

TALLAHASSEE, Fla. (WFLA) – It’s been over three months since the deadly mass shooting on Florida State University’s campus and the investigation remains active.

This biggest legal development in the State vs Ikner case is what hasn’t happened yet. One week ago, Phoenix Ikner’s defense attorney, Peter Mills, said they would be filing for discovery within the week, but according to court records we have yet to see any action.

This delay could dramatically shift the trial timeline, either speeding it up or pushing it back by months, even years.
“Despite what the defense said, they have not filed at this point a demand for discovery. Once again, we’re preparing to respond if they do, we’re also fine if they don’t,” said State Attorney, Jack Campbell.

That filing would trigger the release of a great deal of evidence including hours’ worth of video to sit through from the day of the deadly shooting attack.
“Everything from students taking it to surveillance, to officer body cam, all of that we’ve collected and organized. And so, some of it, it’s much more pertinent than others, but technically all the cameras that were recording everything on the campus that day would be potential evidence,” said Campbell.

As of now, trial is set to start with jury selection on November 3rd, and if that holds, the case could move straight into opening statements that very day.

As for a motive, Campbell says because of the role of ethics any discussion of the facts or evidence would be inappropriate before a jury is selected.
“I’m ethically prohibited from talking about the facts and evidence,” said Campbell. “Throughout trial, I’ll be talking nothing but about the evidence.”

Although the defense has yet to file for discovery, they still have up until October to request access to the evidence being presented against Phoenix Ikner.

8 On Your Side reached out to Ikner’s defense attorney Peter Mills, but have yet to hear back.

The next court date will be on August 13th, 2025, which State Attorney Jack Campbell says could be the time we start proceeding towards trial.
