Manatee County, Mulberry among 25 governments suing state over 'unconstitutional' law

BRADENTON, Fla. (WFLA) — Manatee County and the City of Mulberry just joined a list of 25 local governments from across the state of Florida that are suing the state over Senate Bill 180.

“I think that number (of jurisdictions) is just going to explode and grow,” said Jamie Cole, the attorney who is spearheading the case.

The land use law is described as a disaster bill, helping residents rebuild quickly after a hurricane, without government interference. SB180 prevents all local land development regulations for three years, and stops municipalities from adopting “restrictive or burdensome” changes.

Manatee County commissioners, among others, also believe it favors developers and takes away local governments’ power.

“I don’t want the lawsuit being seen as antagonistic or with animosity. It’s just not a good law, and not good laws need to be changed so they can serve the people,” said Commissioner Carol Ann Felts at a commission meeting earlier this month.

On September 2, Manatee County Commissioners voted 6-1 in order to join the suit, which features areas of the state from Homestead to Orlando, to Naples.

Only Commissioner Mike Rahn opposed the plan.

“We are poking a pretty good bear here. We’ve already felt appropriations get withdrawn or vetoed. We had the DeSoto bridge money get pushed out to 2032. $800 million of it,” Rahn said.

The suit is in its early stages. It calls SB180 an “unconstitutional” law and calls for its removal entirely.
