ORANGE COUNTY, Fla. – A New York woman is suing Disney after she was injured at the Typhoon Lagoon water park’s kiddie area, according to court records filed earlier this month.

In the lawsuit, the woman — identified as Kimberly Panetta — says that she visited the water park in April 2022.

Per that lawsuit, Panetta was standing around waiting for her 4-year-old daughter to come down a kiddie slide, which is when “she was violently struck by a sudden and forceful wave.”

The “mammoth wave” reportedly pushed Panetta to the ground and dragged her along the concrete, causing serious and permanent injuries, she claims.

“It pummeled her, and her body skidded across the cement or gunite, causing serious ‘road rash’ or scrapes that were severe and deep,” the lawsuit reads.

The lawsuit asserts that barriers should have protected Panetta from being thrown around by these sorts of waves.

In fact, Panetta suffered scarring on her legs, which has made her self-conscious, the lawsuit states.

“Panetta, prior to this accident or incident, would be able to wear clothing that exposed her legs, now keeps her legs covered and must tolerate being hot and uncomfortable as a result thereof,” the lawsuit continues.

Now, Panetta is accusing Walt Disney Parks and Resorts of negligence, suing the company for $2 million, court records reveal.

“As a result of this incident, (Panetta’s) vacation was ruined, and she was stuck limping around applying bandages, salves and creams, and was forced to avoid swimming and enjoying planned visits to the parks,” the lawsuit concludes.

This isn’t the first lawsuit filed against Disney over its Florida water park, though.

Back in 2023, another woman accused the company of negligence after she suffered a “painful wedige” while riding on The Humunga Kowabunga — an incident that she alleged left her with major internal injuries.

Meanwhile, yet another lawsuit was filed last year over a woman who was reportedly brain-damaged after tubing on that same water slide.

In that case, she claimed that she was knocked unconscious inside the ride, causing her to nearly drown at the bottom and suffer damage to her internal organs, the legal filings claimed.
