Vermilion Co. dismisses murder charges after new evidence found

DANVILLE, Ill. (WCIA) — The Vermilion County State’s Attorney’s Office is dropping murder charges against a Danville man in light of new evidence discovered after his arrest.

Derrell Boston, 28, was facing charges of first-degree murder in connection to the shooting death of Joseph Jones on Dec. 21. Jacqueline Lacy, the Vermilion County State’s Attorney, said the investigation into Jones’ murder was “extensive” and it eventually gathered evidence suggesting Boston was a suspect.

A Vermilion County grand jury indicted Boston for murder and a warrant was issued for his arrest on Jan. 2. He was taken into custody two days later.

However, Lacy said continued investigation by the Danville Police Department found new evidence that “negated” the evidence against Boston. As a result, Lacy is dismissing the charges against him.

“When a prosecutor knows of new, credible and material evidence creating a reasonable likelihood that a defendant did not commit the offense charged, the prosecutors must remedy the circumstances,” Lacy said in a press release. “Once new evidence is discovered, justice requires, in any criminal prosecution, that the prosecutor in cooperation with police evaluate the new evidence and determine if the prosecution can move forward to a trial.”

Lacy said the investigation into Jones’ death is ongoing, and the new evidence is being reviewed by Danville Police and her office.

Lacy also reminded the public that the crime of first-degree murder has no statute of limitations in the State of Illinois and that any defendant is considered innocent until proven guilty in a court of law.
