AG Bondi Appeals the Kavanaugh Assassination Sentence but That Is the Tip of the Judicial Iceberg

Friday, Federal District Judge Deborah Boardman, a Joe Biden appointee, sentenced the man who attempted to assassinate Associate Supreme Court Justice Brett Kavanaugh to eight years in prison. During a meandering two-hour soliloquy, Boardman tried to justify a sentence that represented a stunning downward departure of 22 years from the sentence recommended by sentencing guidelines and the prosecutors. Attorney General Pam Bondi announced the Department of Justice will appeal the ridiculously lenient sentence.

To put this into perspective, Dominic Pezzola got a 10-year sentence for taking a Capitol Police officer’s riot shield on January 6, 2021, and using it to smash a window in the U.S. Capitol. Anthony Sargent drew a five-year term for literally throwing a rock at the Capitol doors. Allegedly, those draconian sentences were handed out to teach the underclasses a lesson uphold democracy. In Judge Boardman’s world, trying to kill a Supreme Court justice isn’t that big of a deal.

Given the huge downward departure from guidelines ordered by Boardman, the criminal act, and the spurious logic used by Boardman to justify the sentence, there is a good chance this will be kicked back for resentencing. But that isn’t the point. In Oregon, we’ve seen assaults of federal officers, of the kind that drew four-year sentences in the January 6 prosecutions, result in probation or suspended sentences.

In my view, several things are going on here. First, some of the judges appointed by Joe Biden and Barack Obama are using their position to carry on an active resistance to the rule of law. At least twice, we’ve seen federal judges deliberately ignore Supreme Court rulings to delay or frustrate administration efforts to carry out the policies for which the voters elected them; see Supreme Court Answers the Question of What to Call 300K Venezuelans Without Legal Residence in the US – RedState. In the case of the so-called Alligator Alcatraz, a judge who heard the case against the facility didn’t even have jurisdiction over it; see Florida’s Appeal of Alligator Alcatraz Ruling Claims Massive Errors and Bias by the Obama Judge – RedState. The second part of the equation is that the left has opted for political violence as its counter to being frozen out of power and losing popular support; see No, It’s Not Your Imagination—Study Shows Leftist Violence Shoots to Historic Highs – RedState. As this violence increases, we will inevitably see leftist judges treating violent felons with kid gloves because they sympathize with the goals of the defendants. I believe this case serves as a clarion warning of the emerging trend. It isn’t like Boardman is a soft judge.

It was Mr. Ahmed Hussain’s misfortune to be a run-of-the-mill criminal and not a left-wing psychopath.

Unfortunately, there is no way to discipline the obvious acts of unconstitutional resistance to the elected branches by these judges. Impeachment will never happen. The judges aren’t going to recuse themselves from the cases. The Supreme Court lacks the resolve to strip political cases from hyper-partisan leftist judges preemptively. The Department of Justice can’t refuse to deal with judges who have shown themselves to be completely biased against the administration. The net result will be increased violence and damage to the credibility of our judicial system as it refuses to punish leftist street soldiers adequately.
