A HOMEOWNER said his HOA fined him several times over an item on his lawn but the resident said he won by sticking to the association’s rules.

Jared Deluca, a realtor in Queen Creek, Arizona, claimed his HOA penalized him and his husband Tim for their pride flag.

The couple shared a TikTok video that showed their response to their homeowners’ association complaint about their flag.

In the video, Deluca (@jdeluca.realtor) said he responded by taking a “bigger” action. 

“The HOA fined us for how our pride flag was hung,” he wrote in the video’s on-screen caption.

“But no.., we did not take it down…

“We just went bigger.”

The video, from February 2023, showed how Deluca dug a hole in his backyard and inserted a pole.

He then filled the rest of the hole with a concrete mix and inserted an extendable flag pole.

Deluca attached a US flag on top and a pride flag below on the pole and extended it several feet high.

The homeowner said he used the HOA’s own guidelines against them to insert the new pole and flag.

“And yes, the flagpole adheres to the design guidelines,” he said.

The U.S. Sun has previously reported on an update from Deluca on his HOA and flag situation.

Deluca posted another TikTok video, in October 2023, that explained he and his husband had received seven fines and two letters from their HOA.

“I am fairly convinced that they are trying to legally push us out of our home,” he claimed.

“We got fined twice in the month of February,” he added.

“We got fined twice in the month of March.”

In January, Deluca shared a video that said he and his husband had decided to move due to a bad year in real estate and their issues with their HOA.

The U.S. Sun has reached out to Deluca for comment.
