WASHINGTON — Alina Habba, the Acting U.S. Attorney for New Jersey, has announced her resignation following a recent decision by an appeals court deeming her ineligible to hold the position.
“In light of the Third Circuit’s decision and to ensure the ongoing stability and integrity of this office, which I hold dear, I have chosen to step down from my role as U.S. Attorney for the District of New Jersey,” Habba declared in a statement.
She emphasized, “Do not confuse my compliance with surrender. This move will neither weaken the Justice Department nor diminish my resolve.”

Previously, President Trump appointed Habba, who had served as his personal attorney, to this acting position in March.
However, lower court rulings determined that Trump’s appointment of Habba contravened a 1998 law related to federal office vacancies.
