Charlie Kirk’s family has indicated it plans to bring legal action against several Utah authorities following the conservative activist’s assassination last year.
In a newly filed notice of claim, the family alleges a “series of stunning failures and reckless decisions” preceded Kirk’s death at Utah Valley University on September 10, 2025.
The filing was made only days after the first anniversary of Kirk’s death, an event that sent shockwaves through conservative circles and far beyond.
Kirk, the 31-year-old founder of Turning Point USA, was fatally shot during an outdoor campus gathering on the organization’s American Comeback Tour. He had been answering questions from a crowd of roughly 3,000 attendees when he was killed.
Tyler Robinson, the man accused of killing Kirk, remains in custody awaiting a murder trial and could face the death penalty if convicted.
According to the family’s claim, Utah Valley University did not carry out a meaningful security risk assessment before the event. The document specifically alleges that officials failed to examine nearby rooftops overlooking the venue, including the location from which Robinson is accused of firing.
The family also contends that UVU Police had no written event-security plan in place and did not conduct security briefings ahead of the appearance.
“Through a series of stunning failures and reckless decisions, the UVU Parties created a foreseeable danger to Charlie,” the notice obtained by the Daily Mail states.
While Kirk’s relatives have not yet put a dollar figure on the damages they may seek from Utah authorities, the notice says the potential financial losses are “substantial.”

‘Those decisions ultimately rendered Mr. Kirk helpless to the rooftop shooter in an assassination that could have been avoided had the UVU Parties only taken reasonable steps to plan and oversee a safe event, steps outlined below that have been standard practice for other universities hosting controversial speakers,’ the notice read.
The family mentioned that the authorities in Orem, Utah, ought to have been more thoughtful with planning the event, considering Trump’s assassination attempt from a rooftop shooter just months earlier in Butler, Pennsylvania.
‘The risk of a rooftop shooter should have been especially top-of-mind given the attempted assassination of President Trump, Charlie Kirk’s close friend and political ally, by a rooftop shooter the previous year,’ the notice stated.
Kirk’s family notice names State of Utah, Utah Valley University (UVU), the Utah Valley University Police Department, campus police chief Jeffrey Long, Astrid Tuminez, who was UVU’s president at the time of the assassination, and ‘other state actors.’
Kirk’s family criticized UVU Police in the notice for only deploying six campus police officers for the event, representing only 25 percent of the UVU police force despite over 3,000 attendees being at the event.

Following Kirk’s assassination, prosecutors released security footage showing the shooter running across a rooftop to a ‘sniper’s nest’ before taking the fatal shot.
Kirk’s family accused UVU authorities of failing to monitor CCTV footage in real-time, which they say would have allowed them to see the shooter preparing, and ‘Kirk’s tragic death could have been avoided.’

Kirk’s widow Erika took over as CEO of Turning Point USA following her husband’s assassination, however she did not attend the organization’s anniversary tribute event.
Instead, Erika shared a poignant message to social media, saying she has endured the ‘unimaginable’ since Charlie was killed.
She shared a picture of herself walking with their two young children, as she wrote: ‘To every person who has loved us, prayed for us, and carried our children and me before the Lord, not only today, but every day this past year… From the deepest place in my heart, thank you.
‘God, in his mercy, has used so many of you to steady us through the unimaginable. I will never have the words to adequately express what your love and prayers have meant to our family.
‘My Charlie… our babies and myself love you with everything we have.
‘We will carry you with us in our hearts forever and we thank God for every day He gave us with you.
‘Thank you for being the love of my life.’
Erika also marked the day with a post from her wedding day to the conservative activist, showing them holding hands at the altar with the caption: ‘… until Heaven.’
