Denise Richards’ estranged husband Aaron Phypers has claimed that the actress never legalized his adoption of her 14-year-old daughter, Eloise.

According to new explosive court documents filed Wednesday, Phypers, 52, claims that his Real Housewives of Beverly Hills ex, aged 54, had him go through the process of signing adoption papers but allegedly ‘did not’ follow through by submitting them, as per a report by People.

Phypers claimed that he is now legally without his daughter ‘despite raising her as his own.’

Phypers stated that Eloise has been ‘his daughter in spirit and connection for more than nine years’ and emphasized that this situation ‘has resulted in significant emotional strain and highlights the disparity [Richards] creates in this issue.’

Richards adopted Eloise, who was born with a chromosome disorder, as a baby in 2011. She is also the mother of two older daughters she shares with ex-husband Charlie Sheen, 59: Sami, 21, and Lola, 20.

Phypers’ filing was in response to Richards’ request for a judge to order him and his family to vacate their Calabasas home so that she could retrieve her dogs and belongings without violating their temporary restraining order. 

Phypers adopted Eloise in 2019, just a year after he and Richards got married.

‘It wasn’t even a decision. It just is,’ he told People at the time, adding, ‘She’s sweetheart. I love her. I think of her as my own.’

Phypers also calls Eloise his daughter on social media.

In an Instagram post from 2019 he shared a photo of them spending time together with a caption that included the hashtag ‘father & daughter.’

Richards has also shared social media snaps of Phypers with Eloise to her Instagram page in the past. One image even showed Aaron sweetly braiding Eloise’s hair.

Earlier on Wednesday, Richards broke her silence on social media over her shock divorce from Phypers.

The former Bond girl shared a video to Instagram where she was wearing a bright pink top and light pink cap as she sat on a sofa.

The Hollywood star then said that she has been experiencing a ‘s****y’ summer over the heartbreak from her sad split.

‘There is obviously something going on,’ she said referring to her divorce. ‘It’s so hard to go through a divorce… this isn’t my first one, it’s my second one!’ said the movie icon.

And the Wild Things actress added that she ‘never’ thought they would divorce after she called it quits with Charlie.

‘This has been a very difficult time and there are circumstances around my divorce that are difficult to talk about, which one day I will talk about it when the time is right – I just want to process everything and get through this,’ she said as she was interrupted by a dog barking.

‘It has not been easy, so your messages me a lot,’ she said to her fans.

Phypers and Richards were married for six years before he filed for divorce on July 7.

She later accused him of physical abuse and was granted a temporary restraining order on July 16, though he has denied her claims.

This comes weeks after Phypers claimed Richards had shown no interest in their pets for the last two years.

Richards adopted Eloise — who has a chromosome disorder — as an infant in 2011. She also has two older daughters with her ex-husband Charlie Sheen: Sami, 21, and Lola, 20; seen with her girls in 2013

Richards turned up to the home in Calabasas, California where her estranged husband lives with his parents and brother on August 3 in order to get one of her dogs after she accused the star of having another canine put to sleep without her knowledge.

And now Aaron has insisted the actress didn’t have any involvement with the lives of any of their animals.

He told People magazine: ‘Denise hasn’t interacted with the animals in two years and never has wanted knowledge or wanted to give her permission to any type of care for the animals.’

And a source explained the dog who was euthanized was elderly and ‘suffering’ due to health issues.

The insider said: ‘Melanie, a sweet elder dog who Aaron loved, had late stage cancer and was suffering when he took her for help as the vet insisted the few days she had left being in pain were better met with putting her to sleep and off to heaven.

‘It was a painful decision. To say she was ‘put down’ is hurtful.’

Richards currently has a restraining order in place against her estranged husband, ensuring he stays at least 100 yards away from her, so when she showed up to his house for the dog, he immediately left the property.

However, according to audio obtained by People, an emergency dispatcher said Aaron told them after leaving that he ‘fears for his parents’.

According to TMZ, police were called when the Wild Things star barged in and demanded the dog, screaming at Aaron’s parents ‘to get out of the house and putting her finger in their faces’, and allegedly ‘swinging at’ Aaron’s brother and ‘throwing mail’ at him.
