() Former federal prosecutor Neama Rehmani believes Mark Sanchez’s defense will be challenging, despite his not guilty plea to a felony battery charge.
The ex-New York Jets quarterback was discharged from a hospital on Sunday before being taken to the Marion County Jail. He faces charges of felony battery, misdemeanor battery, public intoxication, and unauthorized entry after allegedly assaulting a 69-year-old truck driver.

Sanchez allegedly attacked Perry Tole, 69, in downtown Indianapolis in the early hours of Oct. 4. The former Southern California quarterback was a high-profile NFL analyst for Fox Sports and in Indianapolis to broadcast the Colts’ Week 5 win vs. the Las Vegas Raiders on Oct. 5.
“It’s going to be a very difficult defense … and not only is there video in this case that law enforcement has reviewed, there’s independent witnesses, as well,” Rehmani told “Elizabeth Vargas Reports” on Monday.
“So you know, you may want to argue self-defense in a case like this, because Sanchez was pepper-sprayed and then stabbed, but under Indiana law, it’s very difficult if you’re the initial aggressor.”
Tole told police that Sanchez appeared to be intoxicated and tried getting into his truck. When Sanchez wouldn’t back down, Tole pepper-sprayed him and stabbed him in what he says was self-defense. Both Sanchez and the victim were hospitalized.
Sanchez was seen bloody and wounded in surveillance video obtained by TMZ. According to the chief prosecutor, the attack was captured by multiple surveillance cameras. In the footage obtained by TMZ, Sanchez was seen to be affected in some capacity, ostensibly intoxicated.
“I fully expect to see a plea in this case and a civil settlement,” Rehmani said.
“I’m not just saying this because I went to UCLA, but there’s a history of allegations against him going back to college, as well, so that dirty laundry may come out. … That’s why I expect his team to try to wrap this up as quickly as possible,” he added.
