Indiana man held without bond over child punching incident

MARION COUNTY, Ind. — When Jason Harrell, 46, shuffled into Judge William Nelson’s Marion County superior court room on Tuesday morning in shackles and handcuffs, he signaled his wife in the gallery holding up five fingers and then making a walking motion with two fingers.

Some say this indicated that he expected to be released on a $500 bond and would be home by dinnertime – after he was charged with allegedly cursing and smacking around a teenager on a dirt bike in his neighborhood last weekend.

The Marion County Prosecutor and Nelson had other ideas.

Though Harrell was looking at a $500 cash bond, quite appropriate for a low-level felony charge of intimidation and two misdemeanor battery counts, Deputy Prosecutor Christian Small told the Court the prosecutor was seeking a “no bond” or at least a $2000 bond, which would be commensurate with a domestic violence case.

Harrell told the judge he didn’t quite understand what the prosecutor was asking and Nelson explained that while the defendant could certainly bond out for $500, if the office put its higher bond request in writing and the court agreed, sheriff’s deputies would be sent to Harrell’s house to arrest him on the new higher bond. This would cause the west sider to “be throwing away $500,” on the lower original bond.

The defendant then agreed to sit tight and said he hadn’t made up his mind about an attorney yet. The judge set a Feb. 25 pre-trial date to sort out Harrell’s legal representation and a deadline for filing certain motions.

Harrell went back to jail and his relatives left the courtroom without comment. Three hours later, Nelson agreed with the prosecutor’s request and issued a “no bond” in Harrell’s case, a pre-trial release standard typically reserved for accused killers.

The mother of the boy whom Harrell is allegedly seen pummeling on home security video told affiliate WXIN that she was pleased with the bond decision.

”In my opinion, he should have no bond. He assaulted a child and he’s a grown adult.,” said Britney Schwitzke. “If this was a parent hurting their own child and not a stranger hurting someone’s child, I feel like it would be a whole different story.”

As a condition of his no contact order, if Harrell is eventually released back to his home, he must steer clear of the boy and his family.

”He lives a couple streets over from us and I just feel like the rage that he has towards my family and my son has been so ongoing,” said Schwitzke. “I don’t think a piece of paper is gonna protect my son.”

Harrell would also be placed on GPS monitoring.

His Facebook page lists Harrell’s attendance at a bible college, quotes Biblical passages and advertises his private plumbing business.

Social media posters have republished the home security video of his confrontation with the teen, made references to his business and posted his home address, which Schwitzke said she has deleted over concerns for the safety of Harrell’s family.

At 12 p.m. on Feb. 2, a “Justice for Jordan” motorcycle ride will kick off from Ben Davis High School to show support for the boy.

“I just hope that he would stop bullying people and the other kids about the bikes,” the young teen told WXIN.
