Jose Guerra, a seasoned corrections officer with nearly two decades of service at the Jacksonville Sheriff’s Office, now finds himself embroiled in serious legal troubles. Charged with battery and witness tampering, Guerra’s arrest follows allegations of domestic violence against his wife.

On Thursday evening, the Jacksonville Sheriff’s Office officially confirmed Guerra’s arrest, noting that the Flagler County Sheriff’s Office took him into custody on January 14. The incident reportedly stemmed from a violent confrontation with his spouse.

Details from the arrest report reveal a harrowing sequence of events initiated by a distressing 911 call. During the call, a woman’s desperate cries for help were abruptly cut off, leaving dispatchers without crucial details. As deputies raced to the scene in Palm Coast, a concerned neighbor also contacted authorities, reporting a woman screaming and fleeing from a nearby residence.

Upon arrival, Flagler County deputies encountered the woman on the street. Visibly shaken, she recounted a terrifying ordeal in which her husband had physically assaulted her, including choking and beating. The officers quickly identified the woman as Guerra’s wife and confirmed that Guerra was the alleged perpetrator.

The report states Guerra was detained after deputies were advised there were multiple firearms inside the home.

Guerra’s wife told deputies the couple had been drinking tequila and beer since early that morning and began arguing after a comment about their sexual relationship. She said the argument escalated when her husband yelled at her, got in her face, and began choking and punching her. 

According to the report, deputies noted minor scratches on her and a red mark on her chest. She declined medical treatment and refused to provide a written statement, writing on the form instead, “I’m scared of him.”

Officers say Guerra advised the couple had been drinking and that the argument involved yelling and verbal insults, but he denied that any physical violence occurred.

Deputies reported observing signs of intoxication inside the home, including liquid believed to be alcohol spilled on the floor and multiple beer cans, indicating a physical altercation may have taken place.

The reports say that officers arrested Guerra based on the circumstances and a prior history of verbal disturbances at the residence, citing concerns that the violence could continue or worsen. 

Guerra’s wife stated that Guerra had become physical in March but was afraid to report it due to the possibility that he could lose his job.

According to the report, Guerra has been charged with a misdemeanor count of battery and a felony charge of witness tampering.

This is the third arrest of a Jacksonville Sheriff’s Office employee so far in 2026.
