() A former Justice Department staffer accused of throwing a sandwich at a Customs and Border Protection agent in Washington, D.C., has been released while he awaits trial on federal assault charges.

confirmed Sean Charles Dunn’s release with the U.S. Attorney’s office on Friday. The incident, which went viral after it was captured on video, occurred late Sunday as the White House ramped up law enforcement patrols in Washington.

Dunn approached CBP agents near 11 p.m., pointed a finger at one, called him a “fascist,” and threw a “sub-style” sandwich at the agent’s chest, according to a court filing. Dunn then shouted, “Why are you here? I don’t want you in my city!” before attempting to run away, police said.

Following his arrest, Dunn was fired from his job at the Department of Justice. Attorney General Pam Bondi condemned Dunn’s actions on social media, writing, “This is an example of the Deep State we have been up against for seven months as we work to refocus DOJ.”

Dunn’s next court date is scheduled for Sept. 4, and the attorney general’s office plans to proceed with felony charges.
