New England Patriots players Stefon Diggs and Christian Barmore are both set to play in this Sunday’s final game of the season against the Miami Dolphins, despite facing legal challenges in Massachusetts this week.

“Both are eligible to play at this time,” an NFL spokesperson confirmed to the league’s network reporter, Tom Pelissero.

Stefon Diggs, who is 32 and known for his relationship with rapper Cardi B, was charged on Tuesday with felony strangulation or suffocation, along with misdemeanor assault and battery. These charges stem from an alleged incident on December 2 involving his former personal chef.

Christian Barmore, aged 26, was charged on Wednesday with misdemeanor domestic assault and battery. This charge follows an accusation that he pushed his girlfriend to the ground during an argument in August.

David Meier, legal counsel for both Diggs and Barmore, has publicly denied the allegations on behalf of his clients.

The statuses of both Diggs, a star wide receiver, and Barmore, a starting defensive lineman, can change if they face formal charges in the ‘form of an indictment by a grand jury, the filing of charges by a prosecutor, or an arraignment in a criminal court,’ according to the league’s personal conduct policy.

Unless their respective arraignments are pushed back by judges, the courtroom schedules might represent an obstacle to the Patriots’ title hopes. Diggs is set to be arraigned in Dedham District Court on January 23, two days before the AFC Championship, while Barmore will be arraigned in Attleboro District Court on February 3, which is the Monday before Super Bowl LX.

A former second-round pick out of Alabama, the 6ft5, 315-pound Barmore is accused of getting in a physical altercation with his now-former girlfriend over the air temperature in his bedroom.

According to a December 18 criminal complaint, the alleged victim called police on August 25 to report Barmore, whom she accused of attacking her on August 8.

The accuser told police she took their daughter into his bedroom that morning, where Barmore angry over the thermostat temperature. She claimed she told him that their daughter wanted to see him, but Barmore allegedly responded by pickup up the girl and placing her outside of his bedroom door, which he then slammed shut.

Later, she claimed, Barmore took her phone away while she was calling her mother, prompting her to head to the front door to call for help.

As she told police, Barmore ‘grabbed her before she could [get to the door] and threw her to the floor.’

A car provided by the team took the woman and their daughter to Delaware, she told police. The team has released a statement on the matter, saying officials were aware of the situation when it occurred and did notify the league.

‘The matter remains part of an ongoing legal process,’ the team statement began. ‘We will respect that process, continue to monitor the situation closely, as we have over the past few months, and cooperate fully with the league.’

Meier said in a statement on Wednesday that ‘the evidence will demonstrate that no criminal conduct took place.’

He added that he expects the matter to be ‘resolved in the near future and both parties will move forward together.’

As for Meier’s other client, Diggs is accused of slapping and choking his personal chef during a financial argument at his residence in the Boston suburb of Dedham on December 2. According to the incident report provided to the Daily Mail, the woman said Diggs entered her unlocked bedroom, grabbed her from behind and ‘tried to choke her using the crook of his elbow around her neck.’

She told police on December 16 she feared she ‘could have blacked out,’ before being thrown down onto the bed by Diggs. The accuser initially hesitated to identify Diggs to police ‘due to his fame,’ according to the incident report.

Diggs’ accuser initially began working for him before training camp opened in late July. Her employment was supposed to last through the end of the ongoing NFL season.

Initially, she explained, she was supposed to be paid weekly via wire transfer, but those payments soon became monthly, leading to some friction between herself and Diggs. She also claimed she’s still owed a month’s pay from the former All-Pro receiver.

In early November, she was told by Diggs to leave the residence and ‘go home’ for a week so he could entertain guests. However, she claimed, he did not provide any financial assistance for her to find a flight. And since she did not ask for the time off, the accuser explained to police that she still hoped to be paid for that week.

‘She said that is standard in this type of work arrangement, unless the employee asks for the time off,’ read the police report.

The dispute over her pay escalated over purported text messages, which she shared with Dedham police.

‘You will be paying me out for the season & the money you said you would give me,’ the alleged victim wrote to Diggs.

Diggs responded: ‘I don’t gotta do a mf thing…You can get whoever you want. You got my address, tell them come take the money.’

Following the alleged assault, the accuser said she left her position and stayed with a friend until December 9, when she returned to Dedham to get her property. At the time, she claimed to police, Diggs told her to take up their financial dispute with his assistant, who asked her to sign a non-disclosure agreement.

She told police on December 16 that she refused that request.

‘She spoke to [name removed] from Finance who explained that DIGGS had requested a signed non-disclosure agreement from [victim] before she could be paid. [Victim] did not sign any such document,’ read the incident report.

Diggs allegedly contacted his former chef at one point, telling her via text message ‘you don’t need to do all this,’ but the accuser asked police to tell him to cease communication.

She also believes she was contacted by his girlfriend in text and voice messages, although the police report does not name the person or include any mention of Cardi B.

Although she did not file charges on December 16, the accuser did change her mind and opted to proceed a week later.

The father of Cardi B’s fourth child, Diggs has denied the allegations to the team, as Patriots spokespeople revealed in a statement provided to the Daily Mail.

‘The New England Patriots are aware of the accusations that have been made regarding Stefon Diggs,’ the statement began. ‘Stefon has informed the organization that he categorically denies the allegations.

‘We support Stefon. We will continue to gather information and will cooperate fully with the appropriate authorities and the NFL as necessary. Out of respect for all parties involved, and given that this is an ongoing legal matter, we will have no further comment at this time.’

Meanwhile, the 13-3 Patriots have vowed to keep their focus amid the distractions.

‘I think these are allegations. … Things that we have to handle,’ head coach Mike Vrabel said Wednesday. ‘Every day there are distractions, some are smaller than others. I’m confident that we’ll focus on the Dolphins. And those two individuals will be able to handle the ongoing legal process.’

Barmore missed practice Wednesday due to an illness. And although Diggs practiced, he did not speak to reporters Wednesday, as he’s done throughout the season.
