Sean ‘Diddy’ Combs is gearing up for a legal battle following his recent conviction. On Monday, his legal team made it clear that they intend to challenge the decision, which found him guilty on two counts of transportation for the purposes of prostitution.

While the 55-year-old music icon was cleared of more severe charges, including sex trafficking and racketeering, the convictions he did receive could still result in a four-year prison sentence. This comes after an exhaustive eight-week trial where the stakes were high for the renowned rap mogul.

Through a notice filed in the Federal District Court of New York by his attorney, Alexandra Shapiro, Diddy’s intention to appeal was officially recorded. The document, however, stopped short of detailing the specific grounds for this legal move, as reported by the Daily Mail.

Previously, his defense team argued that the charges should not hold, suggesting that the laws under which he was convicted are outdated, remnants of the Mann Act that are infrequently enforced in modern times.

In the coming weeks, more comprehensive documents are expected to be filed, which will likely elaborate on the rationale behind Diddy’s appeal. As the case progresses, all eyes will be on the legal strategies employed to overturn the current verdict.

The Daily Mail has reached out to Diddy’s representative but has not yet received a response.

Diddy’s appeal would initially be heard by a three-judge panel from the Second Circuit Court of Appeals.

Diddy was still listed as being jailed at the Metropolitan Detention Center as of Monday afternoon, according to the Federal Bureau of Prisons. 

Federal prison consultant Sam Mangel told the Daily Mail that defendants typically wait 45 to 60 days to be transferred to a federal prison to start their sentence. 

However, because of the federal shut down, Diddy could be waiting in Brooklyn MDC longer than usual, Mangel said. 

On October 3, Judge Arun Subramanian sentenced Diddy to 50 months in prison after his conviction on the two prostitution charges, but he has been credited with the year he already spent in jail at Brooklyn’s Metropolitan Detention Center ahead of and during his trial. 

His legal team had argued for a far more lenient sentence of just 14 months in prison.

When the 12 months he had already spent in jail were subtracted from the total, Diddy would have only served an additional two months in prison under his preferred sentencing terms. 

By contrast, prosecutor’s had requested a sentence of at least 11 years and three months in prison.

Diddy’s demeanor at his sentencing hearing was a far cry from how he responded earlier to the jury’s verdict. 

The music executive reportedly got down on his knees and rested his head on his chair to pray after he was acquitted of the most serious charges while his lawyers hugged each other.

His attorney Marc Agnifilo later claimed that the former hitmaker received a standing ovation from his fellow inmates when he returned to jail, according to the Associated Press.

However, Diddy was reportedly consumed by tears and clutched his head in his hands during emotional testimony during his sentencing hearing. 

In addition to his 50-month sentence, he was also ordered to pay a $500,000 fine.

A juror later told ABC News that they thought Diddy had gotten a light sentence for his crimes. 

‘I think he got off easy. I’m surprised the judge was that lenient,’ they said in a statement. ‘I think 10 years would have been more appropriate. He has many more civil suits filed against him, so he will be in and out of court for years. I’m sure he will have more fines to pay, too.’

During his trial, Diddy’s attorney claimed that the sexual encounters he was charged in relation to were all consensual.

The defense team and prosecution had butted heads after his conviction over what evidence the judge was allowed to consider when determining Diddy’s sentence.

The rapper’s lawyers had argued that Judge Subramanian should exclude information related to the more serious charges that he had been acquitted on.

‘Mr. Combs must be sentenced for what the jury convicted him of — interstate transportation of fully consenting adults with intent to engage in prostitution,’ Diddy’s attorney wrote in a September filing. ‘But it would be unlawful, and a perversion of justice, for the Court to sentence him as if the jury had convicted him of sex trafficking and RICO, or to increase his sentence based on the Court’s own findings about force or coercion or racketeering.’

However, the judge said at the October 3 sentencing hearing that ‘no limitation shall be placed on the information concerning the background, character, and conduct’ for the purposes of determining a sentence, according to the New York Times. 

As part of the sentence, the judge recommended that Diddy be incarcerated as near to New York City as possible, per his request.

He also recommended that the music mogul be considered for admission into a drug and alcohol abuse treatment program.
