Watch: Portland Accuses Federal Agents of Excessive Force During ICE Demonstrations

In a revealing turn of events, new surveillance footage captures the tense interactions preceding confrontations between federal forces and demonstrators outside Portland’s Immigration and Customs Enforcement (ICE) facility over recent months.

These videos, presented by the Oregon Department of Justice, serve as critical evidence in their legal efforts to halt the federal deployment in Portland. Alongside this footage, Portland police provided testimony highlighting what they described as unjustified and excessive force by federal agents.

According to the Oregonian, Portland Police Commander Franz Schoening underscored in his testimony, “The level and extent of force exercised by federal law enforcement are excessive and disproportionate.”

Despite claims to the contrary about tensions between ICE and Customs and Border Protection (CBP), sources suggest otherwise. Meanwhile, an incident involving protester Daryn Herzberg II, who was forcefully subdued by federal officers outside the ICE facility on South Macadam Avenue on August 13, has gained attention. Newly released video footage provides additional perspectives on these interactions, as first detailed by Nexstar’s KOIN.

In the new videos, Herzberg is clearly seen standing at the edge of the property on the sidewalk wearing a bright, multi-color overshirt. He can be seen holding a boombox and looking in the opposite direction when two agents run up behind him and push him face-first onto the ground.

As Herzberg tries to get up, the two officers grab him and he hits the ground again. Gas is deployed nearby and other officers swarm the crowd of roughly 10 people standing on the sidewalk outside the building.

In another one of the building’s surveillance videos from Aug. 16, Herzberg can be seen wearing the same bright shirt while standing on the sidewalk and walking away from the building as an officer runs up behind him and knocks him to the ground as other agents gather around them. Gas begins to sweep through the frame, making it impossible to see what happens next.

Another video from Sept. 30 shows a group of agents coming out of the facility in an attempt to clear the group of protesters who had gathered on the sidewalk out front, as well as on the sidewalks across the street.

Officers are seen pointing and then physically pushing protesters who are filming with their phones, knocking at least two people to the ground. Several people are taken into custody during the 10-minute clip, including one who is physically dragged across the ground by two officers attempting to move the person from the sidewalk into the building.

In another clip from Oct. 2, a group of officers appears to be moving back inside the facility when a protester steps over the line between the sidewalk and the driveway. An agent is seen breaking through the group of agents who were retreating and charging the protester who stepped over the line. The protester can be seen trying to run away, but falls to the ground as officers crowd around him in the street.

On Sunday, a federal judge barred the troops’ deployment until a final ruling is made Nov. 7.

Herzberg’s attorney told KOIN they expect to file a federal case against the Department of Homeland Security early next year.

KOIN reached out to ICE for comment but did not immediately hear back.
